Chapter 38. Voluntary participation by organizations in a community eco-management and audit scheme (EMAS)
Regulations relating to pollution control (Pollution Regulations). This is an unofficial translation of the Norwegian regulation.
Laid down pursuant to sections 52a, 52c, 81 and 85 of Act no. 6 of
38-1. EEA agreement Appendix XX no. 2fa (Regulation (EC) no. 761/2001) regarding voluntary participation by organizations in a community eco-management and audit scheme will be the applicable Regulations, with the amendments that follow from Appendix XX, protocol 1 to the agreement, and the agreement otherwise.
38-2. Accreditation and registration
Norwegian Accreditation (NA) is a national accreditation body, cf. article 4 of the Regulation.
The Brønnøysund Register Centre is the national registration body, cf. article 6 of the Regulation, and also collects fees, pursuant to this chapter, cf. article 16 of the Regulation.
38-3. Logo
The Norwegian version 1 of the logo, cf. Appendix IV to the Regulation is: "Kontrollert miljøledelsessystem" (Verified environmental management).
The Norwegian version 2 of the logo, cf. Appendix IV to the Regulation is: "Bekreftet informasjon" (Validated information).
38-4. National standard body

38-5. Organizations liable for fees
Each entity to be registered, cf. article 2 of the Regulation, must pay fees, pursuant to this chapter.
38-6. Fees
The total fees must not exceed the costs incurred by the Brønnøysund Register Centre in connection with administration, following the control
In connection with initial registration of an organization, cf. article 3, point 2, of the Regulation, the organization must pay a fee of NOK 5,000.
In order for the organization to maintain registration and to have the environmental management system and audit programme verified, cf. article 3, point 3 a of the Regulation, cf. Appendix V, point 5.6, subsection 1, the organization shall pay a fee of NOK 5,000.
In order to maintain registration and to have annual updating of the information, including approval of amendments, cf. article 3, point 3 b, of the Regulation, cf. Appendix V, point 5.6, subsection 2, and Appendix III, point 3.4, the organization shall pay a fee of NOK 3,000.
An overdue fee may be collected through enforcement measures.
38-7. Changes to fees
The Brønnøysund Registe Centre can change the fees, rounding them to the nearest NOK 100, in accordance with changes to the consumer price index between 1 October – 30 September. The change shall enter into force on the following 1 January.
38-8. Exceptions
The Ministry of the Environment or the entity so authorized by the ministry may make exceptions to these regulations in special cases, as long as they do not conflict with the EEA agreement.
38-9. Appeals
Decisions made by the Brønnøysund Register Centre or Norwegian Accreditation (NA) in accordance with this chapter may be submitted to the Ministry of the Environment.
