Guide to chemical suppliers

Under these regulations dangerous chemicals are defined as those chemicals that may be hazardous to health or the environment or represent a fire or explosion hazard.

EU harmonised regulations
The Norwegian regulations on classification, packaging and labelling of dangerous chemicals are almost fully harmonised with the corresponding EU legislations.

Responsibility
Any person that places on the Norwegian market dangerous chemicals for occupational or private use has duties pursuant to the Norwegian regulations.

Main duties
Dangerous chemicals shall be correctly classified, packaged and labelled before being placed on the market. Safety data sheets shall be provided with the chemicals when they are first supplied to professional users. Norwegian language is mandatory for warning labels and safety data sheets.

The responsibility for compliance with the provisions of the regulations lies entirely with the person placing the chemical on the market. No approval of either labels or safety data sheets is given by the authorities. The authorities may impose coercive fines, writs or penal measures in case of non-compliance with these regulations.

Derogations from EU legislation on classification and labelling
Norway will until further notice continue to apply the following:
• Different classification and labelling than the EU of
  10 substances with respect to health hazards

Duty to declare chemicals to the Product Register
Dangerous chemicals which are placed on the market in Norway in amounts of 100 kg or more per year shall be declared to the Norwegian Product Register. Declarations of other chemicals are voluntary.

Very toxic and toxic chemicals
Chemicals that are labelled “very toxic” or “toxic” cannot be placed on the market without a special permit if intended for non-professional use. These restrictions are laid down in regulations relating to restrictions on use etc. of certain dangerous chemicals.
